1. Acceptance of Terms

These Terms and Conditions govern the relationship between Jetsetter Holidays, the Destination Management Company, and the Client. By booking services with Jetsetter Holidays, the Client agrees to be bound by these Terms and Conditions.

2. Definitions

Destination Management Company: Jetsetter Holidays (Pvt) Ltd

Client: Any person or entity that books services with Jetsetter Holidays.

Services: Travel-related services extended by Jetsetter Holidays, including but not limited to accommodation, transportation, tour programs, guide accompaniment and activities.

3. Bookings and Payments

When making a booking, you agree to provide accurate and complete information. You are responsible for ensuring that the details provided are correct. You agree to pay all charges associated with your booking, including any applicable taxes and fees. Payment terms may vary based on the specific travel arrangements and will be detailed at the time of booking.

4. Cancellations and Refunds

Cancellation and refund policies vary depending on the service provider or travel supplier. It is your responsibility to review the specific terms and conditions related to your booking. We will assist you in understanding these policies, but we are not responsible for any cancellations, changes, or refunds outside of our control. Refunds, if applicable, will be processed according to the terms of the travel supplier.

5. Travel Documents

You are responsible for ensuring that you have the necessary travel documents, including passports, visas, and any other required documentation. We will provide general information on travel requirements but are not responsible for any issues arising from incomplete or incorrect travel documentation.

6. Changes to Booking

If you need to make changes to your booking, please contact us as soon as possible. Changes may be subject to availability and additional charges. We will do our best to accommodate your requests, but we cannot guarantee that changes can be made.

7. Liability

Jetsetter Holidays acts as an intermediary for independent suppliers such as hotels, transport companies, tour operators, and other service providers. We do not own, manage, or operate these independent suppliers. Therefore the client acknowledges that Jetsetter Holidays is not responsible for any acts, omissions, errors, negligence, or misconduct of these third parties, nor for any personal injuries, death, property damage, or other damages or expenses resulting from their actions.

Jetsetter Holidays shall not be liable for any failure or delay in performing its obligations under these Terms and Conditions if such failure or delay is caused by events beyond our reasonable control, including but not limited to acts of God, war, strikes, labor disputes, epidemics, pandemics, government actions, or any other cause beyond our control.

In any event, the total liability of Jetsetter Holidays for any claim arising out of the services or these Terms and Conditions shall be limited to the total amount paid by the Client for the specific services giving rise to the claim.

8. Insurance

We strongly recommend that you purchase travel insurance to cover any unforeseen circumstances that may affect your travel plans. Travel insurance can provide coverage for trip cancellations, medical emergencies, lost luggage, and other potential issues.

9. Travel Risks

The Client acknowledges that travel involves inherent risks associated with certain services. By booking services with Jetsetter Holidays, the Client voluntarily assumes all risks associated with travel and agrees that Jetsetter Holidays is not responsible to guarantee the safety or security of the Client and their belongings.

10. Intellectual Property

All content on our website and marketing materials, including text, graphics, logos, images, and software, is the property of Jetsetter Holidays or its content suppliers and is protected by intellectual property laws. You may not reproduce, distribute, modify, or create derivative works of any content without our express written permission.

11. Privacy

We are committed to protecting your privacy. Our Privacy Policy, which is available on our website, explains how we collect, use, and protect your personal information. By using our services, you consent to the practices described in our Privacy Policy.

12. Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of Sri Lanka.

For all dispute resolutions, prior to initiating any legal proceedings, the parties agree to attempt to resolve any disputes through good faith negotiations. If such negotiations fail, the dispute may be referred to mediation or arbitration, as mutually agreed upon by the parties.

13. Changes to Terms

We reserve the right to modify or replace these Terms at any time. Any changes will be effective immediately upon posting. Your continued use of our services following the posting of any changes constitutes acceptance of those changes.
